Default Cross-dressing HIV positive faggot undocumented immigrant fears for his safety if deported to Mexico


FLINT, MI - A gay, cross-dressing, HIV-positive undocumented immigrant is fighting deportation to Mexico because he fears retaliation for his lifestyle and a lack of adequate medical care.

Demecio Flores-Martinez, 38, filed a federal lawsuit on Monday, May 15, in Flint U.S. District Court asking a judge to stay his pending removal while reviewing the lawfulness of the deportation, according to court documents.

The lawsuit seeks humanitarian relief based on Flores-Martinez's medical condition. He has been HIV-positive for 13 years, requires ongoing medical treatment indefinitely and will suffer harassment due to his sexual orientation if returned to Mexico, the lawsuit alleges.

Flores-Martinez is openly gay and enjoys cross-dressing. When he initially arrived at the Monroe County Jail, correctional officers thought Flores-Martinez was transgendered and receiving hormone replacement therapy to change from male to female, the lawsuit said.

He currently takes five different medications on a daily basis to treat his HIV and the average costs for these medications is $4,000 per month, according to the lawsuit.

Because he does not reside in Mexico, Flores-Martinez does not qualify for medical care or medical insurance provided by the government there, court documents said.

He also is asking for humanitarian relief based on his sexual orientation, according to the lawsuit.

If Flores-Martinez is deported to Mexico, he will be sent to a small village called Pastoria in Ojocaliente that is in the province of Zacatecas. He will be exposed to gang violence and constant harassment because he is openly gay, the lawsuit says.

A third claim in the lawsuit asks a judge to consider allowing Flores-Martinez to stay in the U.S. based on a U-Visa application.

A U-Visa is set aside for victims of certain crimes who have suffered mental or physical abuse and are helpful to law enforcement or government officials in the investigation or prosecution of criminal activity, the lawsuit said.

Flores-Martinez became eligible for the U-Visa on July 2, 2014, when he was the victim of an alleged armed robbery outside a known gay club in Detroit called GiGi's, according to the lawsuit.

In April, Flores-Martinez pleaded no-contest in U.S. District Court in Detroit to illegal reentry and was remanded to the custody of the U.S. Marshal's Office, according to court documents. *He was ordered not to reenter the U.S. without permission from the proper authorities and fined $100.

He was arrested on Feb. 9 by the Oakland County Sheriff's Office, who said there was a warrant for his arrest, the lawsuit said.

Flores-Martinez initially came to the U.S. without inspection at the age of 16, according to the lawsuit. In November 1997, he was issued an*order of removal from the U.S., but subsequently re-entered the country and has been here since, the lawsuit said.*
